These Terms of Service govern the access to and use of Digiyogi Technologies Pvt. Ltd’s (“Company” / “We”/ “Our”) ‘Kalaloka’ website (www.kalaloka.com) (“Website”), the ‘Kalaloka’ application available on Android and iOS (together “Application”) by any person (“User”/“You”/“Your”).

Company, on its Application, primarily facilitates a User to:
  • Publishing Art works(Rangoli, Paintings,Sketches,Various Crafts works,any other type of Art works), Literary Works ( Stories,poems,articles,Novels etc) , Audio works ( Stories, Poems, Knowledge sharing, books etc), Videos ( Yakshagana, Nataka, Stories, Folk Songs, knowledge sharing etc) on Application by user is referred as “Author”, and/or
  • Consuming the Publisehd works and content by Company on Application by user is referred as “Reader”
  • Published Content and Company Content shall together be referred as “Content”.

1. Introduction

Welcome to Kalaloka, a creative community where users can share stories, artworks, crafts, audio stories/books, and videos. By accessing or using our platform, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.

2. Acceptance of Terms

By registering for and/or using Kalaloka, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

3. User Accounts

3.1 Registration

To use certain features of the platform, you must create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.

3.2 Account Security

You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

4.1 Ownership

You retain all rights and ownership to your content. By posting on Kalaloka, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the platform.

Do not reproduce any Content from the Application and publish it on any other platform or medium without authority or prior written permission from the Company, whether for commercial gain or otherwise.

Company will have the right to Modify the Post for Affiliation, Ads and for any other promotional activity. Company will not change the Content of Author.

4.2 Content Guidelines

You agree not to post content that is illegal, offensive, defamatory, or infringes on the rights of others. We reserve the right to remove any content that violates these guidelines

To access and use the Services solely for the User’s personal and non-commercial purposes, except as allowed on the Application, and to not access the Application or obtain the Content through any means other than as permitted.

4.3 Responsibility

You are solely responsible for the content you post. We do not endorse or assume any liability for any content posted by you or any third party.

Do not to contact or target users in any way, including through features or published works, that is considered spam and that has the intent of getting users to remove their content from the website or application, onboard users and/or their published content onto other content platforms, or start a conversation with users about the aforementioned.

5. Prohibited Activities

You agree not to engage in the following prohibited activities:

  • Using the platform for any illegal purpose.
  • Posting content that is abusive, threatening, obscene, or otherwise objectionable.
  • Impersonating another person or entity.
  • Distributing viruses or any other harmful computer code.
  • Engaging in any activity that interferes with or disrupts the platform.
  • Posting others works/ contents/photos/cover images.

6. Intellectual Property

6.1 Platform Content

All content on the platform, excluding user-generated content, is the property of Kalaloka and is protected by copyright and other intellectual property laws.

To enhance the User's experience on the Application, the Company may provide Other features ,such as the ability to (i) review the Content, (ii) chat with other Users, (iii) set a username, upload a profile picture, and enter other information on the User's profile. There are few more features will be added as enhancement to Application.

6.2 Trademarks

The trademarks, logos, and service marks displayed on the platform are the property of Kalaloka. You are not permitted to use these trademarks without prior written consent from Kalaloka / Digiyogi Technology.

7. Termination

We may terminate or suspend your account and access to the platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users or the platform itself.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the platform will be available at all times or that it will be free of errors or interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Kalaloka shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the platform.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any bugs, viruses, or other harmful code that may be transmitted to or through our platform by any third party.
  • Kalaloka does not guarantee that you will earn any income through your blog or content. The amount of income you may earn is dependent on numerous factors, including but not limited to the quality of your content, the traffic to your blog, the engagement of your audience, and the specific monetization methods you use.
  • Kalaloka is not responsible for any discrepancies, delays, or failures in payment from third-party services such as advertisers, affiliate programs, or sponsors. We provide a platform for content sharing but do not manage or guarantee payments from these external sources.
  • Your engagement with third-party services for monetization (e.g., Google AdSense, Amazon Associates) is solely at your own risk. [Platform Name] is not responsible for the policies, terms, or actions of these third parties, and you should review their terms and conditions independently.

You agree to indemnify and hold harmless Kalaloka, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms and Conditions, or your infringement of any intellectual property or other right of any person or entity.

By using the Application and its services, You signify that You are at least eighteen (18) years old and have the legal capacity to enter into a legally binding agreement with the Company. If You are under the age of eighteen (18), You must get permission from Your parent(s) or authorized legal guardian(s), who will be in charge of ensuring that You accept and abide by these Terms of Service. Should the Company ask for it, You must provide Your parent(s) or authorized legal guardian(s) consent as soon as possible. You must cease using the Website/Application right away if Your parent(s) or approved legal guardian(s) have not given You permission to do so.
